End-User License Agreement
The following End-User License Agreement ("EULA") apply to your use of the any software provided by VESNX SA. website https://www.asp-waf.com , as well as samples hosted at github.com/ASP-WAF or ASPWAF at NuGet as well as any associated services. The most current version of the EULA can be reviewed by clicking on the "EULA" hypertext link located at the bottom of our Web pages. You can access the general Terms and condition that govern the services and the website here.
The Software references the binary in its compiled as well as decompiled form as well as any other artifacts included in NuGet Package listed in NuGet.
The Owners references Walter Verhoeven and Lambert Snellinx as individuals and VESNX SA with Luxembourg business ID: B 218.421, as its agent.
Valid License defines a license that has not expired and is registered at www.asp-waf.com. See Terms and Conditions at ASP-WAF software and service terms for the licensing terms. Terms and conditions are subject to change.
The License Server refers a web application hosted at https://service.asp-waf.com. This service is monitored and the data is
hosted in the European union and subject to EU privacy.
Please note that this system is for use in accordance with our terms and conditions only and that we are monitoring access and use. Anyone accessing this server expressly consents to such monitoring and is advised that if such monitoring reveals possible evidence of criminal activity, system administrators may provide the evidence of such monitoring to law enforcement officials and any licenses you may have bought may be revoked.
Please read this End User License Agreement, hereafter called EULA carefully before completing any installation or distribution process when using "the software". It provides the condition associated with license to use "The software" and contains warranty information and liability disclaimers.
This End-User License Agreement ("EULA") is a legal agreement between you and "the owners".
If you register for a free trial of "the software", this EULA agreement will also govern that trial. By clicking "accept" or installing and/or using "the software", you are confirming your acceptance of "the software" and agreeing to become bound by the terms of this EULA agreement.
If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use "the software".
This EULA agreement shall apply only to "the software" supplied by VESNX SA herewith regardless of whether other software is referred to or described herein. The terms also apply to any VESNX SA updates, supplements, Internet-based services, and support services for "the software", unless other terms accompany those items on delivery. How do we collect your data?: We send your domain name as well as "the software" release to our cloud service web service.
How will we use your data?: We will periodically validate that you're not in violation of our license agreement by visiting your site.
How do we store your data?: We store your data electronically in a database physically located one of our business premises.
How do we transmit the data?: Data is send using a SSL session with "the license server". The license data in the SSL tunnel is ciphered using a PGP key provided via a PHP handshake with the server and can only be ready by the server as only the server has the private key.
If license server is not accessible from your network "the software" may not perform as expected and may even terminate the application.
Users with a license level of Trial, Community or Base may exchange known malicious user activity with the subscription server. If you do not wish to participate with the data improvement program you will need to get a Small business or enterprise license.

Owners hereby grants you a personal, non-transferable, non-exclusive license to use "the software" on your devices in accordance with the terms of this agreement.
You are permitted to load "the software" (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of "the software" software.
YOU ARE NOT PERMITTED TO:
Owners shall at all times retain ownership of "the software" as originally downloaded by you and all subsequent downloads of "the software" by you.
"The software" (and the copyright, and other intellectual property rights of any nature in "the software", including any modifications made) are and shall remain the property of Walter Verhoeven and Lambert Snellinx.
"The owners" reserves the sole right to grant, or not to grant, licenses to use "the software" to third parties.

You acknowledge that "the software" contains trade secrets and other proprietary information of "THE OWNERS" and its licensor's. Except to the extent expressly permitted by this Agreement or by the laws of the jurisdiction where you are located, you may not decompile, disassemble or otherwise reverse engineer "the software" or engage in any other activities to obtain underlying information that is not visible to the user in connection with normal use of "the software".
This EULA agreement is effective from the date you first use "the software" and shall continue until terminated. You may terminate it at any time upon written notice to "the owners".
It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of "the software". The provisions that by their nature continue and survive will survive any termination of this EULA agreement.
If you fail to pay any fees related to "THE SOFTWARE" or any related service, or violate any term or condition of this EULA, "the owners" or its agent may terminate this license immediately by giving notice of termination to you. You are responsible for providing valid contact information to "The owners". If no valid contact information is available for you in "the owners" records, then "the owners" are not required to give a notice of termination to you
By using "the software" you explicitly agree and understand that we will send usage data to our license server in order for us to validate agreements to these terms and licensing conditions. If you do not agree to these terms you may not use "the software".
3rd party software: The solution provided may contain dependencies that have their own license agreements before you are able to make use of them. Please validate that you are in compliance with those licenses.
Software Updates: At present we do not offer a subscription service, in order to keep "the software" up to date you should update the software regularly and re-deploy this on your website.
Service Agreements We are not obligated to support you in any way when using our software Service agreements in regards to SLA and support tickets are managed by their own terms and conditions.

"The Software" may have dependencies on external binaries that come with their own license agreements and terms and conditions. "THE OWNERS" do not grant you licensed access and you will have to agree to and accept 3rd party terms before being able to use those 3rd parties.
"The software", at the time of compilation, does not contain any 3rd party binaries that are not in the public domain. Exceptions to this are extensions that need to be downloaded separately like
All 3rd party software comes with a "community" or a "paid license" that must agree to before you are able to use the extensions.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
IN NO EVENT SHALL "THE OWNERS" OR ITS LICENSORS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL, DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THIS SOFTWARE,
EVEN IF "THE OWNERS" HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES/COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of Luxembourg and the terms as specified by ASP-WAF software and service terms
