These Terms and Conditions are for the use of the documentation and software provided by VESNX SA., hereafter called the company.
The Company reserves the right to update these terms and conditions at any time without any notice to the user.

The Software mainly refers to software related to but not restricted to Firewalls and data protecting tools.
The License defines the different types of software and requires a yearly payment.
VESNX SA and its respective suppliers are not liable for any special, specific, direct/indirect or consequential damages or any damages of any kind resulting from loss of Use, loss of Data or loss of profits that arise or may arise in any way due to performance issues of the services of the Software, the documentations, videos, provision of or failure to provide service or any information available from the services from the software.

The information available on the website asp-waf.com is for qualified professionals and companies.
The website has to be considered by the user as help to register and to integrate the NuGet Packages in your application.
The software is available for professional use only.
VESNX SA provides software that is delivered AS IS.
Any use of software without registration is prohibited.
The Community edition also implies a registration. The community edition is free of charge.
The Community Edition is free as it is part of the Product Improvement Program and will transfer malicious user patterns discovered on your web application or services and sends the detected patterns, connection details and interactions to the subscription serviced in a GDPR compliant anonymised dataset so that other firewall instances can learn and early detect and identify bad-faith actors. If you do not agree to sharing discovered malicious activity then you should obtain a paid version and opt-out of the customer improvement program.

All software can be downloaded via Nuget.org, this website via this link of directly from within the IDE of software like Microsoft Visual studio and JetBrains Rider.
Before integrating any binaries in your application, you must accepts these terms and conditions that are included with each package.
Each NuGet Packages owned or distributed by VESNX SA comes with a specific license terms and conditions that you must accept before integrating any binaries into your application and services.
Licenses fees must be paid with 60 calendar days from invoicing. VESNX SA reserves the right to pause any and all services until disputes are settled.

Unless otherwise specified Firewall license levels of Data-center and Embedded are also subject to these terms and conditions.
All licenses and subscriptions are valid for 1 year unless specified otherwise.
The use of the software can be free for educational purposes.
Therefore schools, universities and other institutions will have to apply
for a specific educational license. These licenses are only given for a fixed duration and
must be renewed periodically.
In case of nonpayment you agree that VESNX SA has the right to:
You agree to and understand that altering the license level may result in some featured reacting differently or not being available. You understand that this may result in downtime and exposed vulnerabilities to any software using any binary covered by these terms and conditions.
VESNX SA reserves the right to act differently in each situation and for each license in its own interest.
If you received the software via a 3rd party supplier and the 3rd party supplier fails to honer his agreement you the end-user of will be invoice directly based on the features used. Any disputed between you the end-user of the software and a 3rd party provider are between you the end-user and the 3rd party provider.
If volume licensing is agreed on then you the End-User, agree that VESNX SA has the right to perform a true-up. When a true-up is done by VESNX SA (or it's representative) and you the End-User, compare the number of actual software license used to the good faith estimate of the initial contract. and you will pays the difference in the licensing fees.
All software is copyrighted by VESNX SA or its suppliers. Use of the software is governed by terms and conditions that must be approved by the user before installing/implementing the software by the user.
Without any limiting the foregoing, copying or reproduction of the software or redistributing of the software is completely prohibited.
Any act of the above-mentioned use or distribution of the Software will be considered a violation of these terms and conditions.
Illegal use of the software any illegal installed or distributed software will be subject to an indemnity for VESNX SA with a minimum of 50.000 euro per violation, per month.
The communication between your application and servers of VESNX SA is initially only a license check.
The license check will be automated and frequented as needed.
Depending on your license and subscriptions you understand and agree that your application will be subject to more communication and data storage.
Entry level or free license are subject to our you agreeing to product improvement program.
Any information send is anonymised and encrypted before it is send to VESNX SA
All information send to VESNX SA will analyzed, process and made available to the data subscriptions.
You as the End-User agree to us sharing exploits and attack vectors are shared with law enforcement and reputable third parties like NIST, Microsoft, IBM Red Hat, Canonical as well as internet service providers.
VESNX SA does not give any rights or remuneration of any kind (intellectual property, licensing, or any other kind) to any user of the software or to any bringer of information considering feedback to the software and its features, new ideas that can be implemented, new products, technologies, product names.
In general, VESNX SA has the right to use all information given by the user to improve its products without any compensation.
Gathered information by campaigns of any kind will be without any compensation (financially or intellectual property).
VESNX SA considers all kind of input as its own (intellectual) property and acts with full commercial rights.

No materials can be used without respecting the terms and conditions.
Based on the integration of any artifact in any service or application by the user VESNX SA has the right to consider a license to be accepted and activated.
In case of a legal dispute must be addressed to the home office of VESNX SA.
For all disputes of any kind, the Court and legislation of Grand Duchy of Luxembourg are applicable.
VESNX SA has the right for any claim, to organize an arbitration procedure in Grand Duchy of Luxembourg.
In this arbitration procedure, one or more arbitrators will deliver a binding decision.
We refund to the same payment method you used when you bought the product. We will refund the same credit card or refund to the same bank account. To prevent abuse, we do not accept one type of payments and use a different type for the refund.
All our customers have the same refund policy, we do not differentiate between EU and non-EU clients when it comes to service, every one by law gets 14 days on any items bough. There are some limitations, but in general we are happy to refund within 30 day. have a look at the refund policy for details.
